| Summary, etc. | La seguridad alimentaria nacional se refiere a la disponibilidad suficiente y estable de alimentos, así como el acceso y el consumo oportuno y permanente de los mismos en cantidad, calidad e inocuidad por parte de todas las personas, bajo condiciones que permitan su adecuada utilización biológica para llevar una vida saludable y activa (DNP, 2008). Esta investigación tuvo como objetivo analizar y observar el régimen jurídico de la seguridad alimentaria y nutricional en Colombia basados en la Política de Seguridad Alimentaria y Nutricional - PSAN (CONPES 113 de 2008), a través de un análisis internacional, nacional y regional como derecho fundamental. La finalidad de la investigación fue establecer si prevalece este derecho constitucional o si, por el contrario, se trata de un derecho abstracto. Para el efecto se usaron los instrumentos jurídicos con que cuenta Colombia, observando la normatividad vigente en pro del cumplimiento de los ODS; así mismo, reflexionando sobre las garantías del Estado colombiano y los vacíos jurídicos que conllevan a las limitaciones a este derecho, bien por lo que se conoce como regla fiscal, o por falta de voluntad política. |
