| Summary, etc. | Durante el desarrollo de esta investigación Socio-Jurídica que se define como metodología que busca generar resultados de impacto o análisis a través hecho social particular. En este caso, se evaluará lo que corresponde a la definición de una acción de tutela como ejercicio del pleno derecho. Cuando una tutela no es atendida de manera favorable o desfavorable al accionante esto se considera una completa vulneración generando conflictos y sanciones por su incumplimiento. La labor principal del juez es manifestar o decidir la tutela, actividad que no debe ser el resultado de una labor mecánica. La adopción de una decisión tomando como referencia los enunciados jurídicos, es sin duda un acto en el que existe siempre un cierto margen de valoración ya sea positiva o negativa. |
