| Summary, etc. | En Colombia los pueblos indígenas están legalmente reconocidos por la constitución, y le otorga facultades a las jurisdicciones especiales indígenas para administrar acceso de justicia, otorgando un sistema de derecho propio; dicho sistema debe velar por los intereses de cada miembro de su comunidad y en especial del menor, como también, del ejercicio en pleno de derechos y garantías bajo a las consideraciones que da la ley en cuanto a su cultura. Se escoge como escenario para la investigación el Departamento de La Guajira, que se puede considerar como el más afectado, sin dejar atrás lo que actualmente padece el Departamento del Chocó y otras regiones étnicas del país. En La Guajira habitan más de 500.000 personas que pertenecen a varias culturas indígenas, árabe y criolla así mismo, cinco grupos indígenas residen dentro de su territorio: wayuu, yukos, motilones, kogui y wiwa los criollos viven principalmente en los asentamientos urbanos y los euro-asiáticos: (árabes o "turcos"), en el Municipio de Maicao. |
