| Summary, etc. | "Definitivamente el derecho de acceso a la justicia es un tema fundamental en la consecución de los postulados constitucionales tales como el de Estado social de derecho. Siendo Colombia un país en el cual históricamente se han presentado, con una frecuencia significativa, diversos tipos de conflictos, ya sean de carácter social, político, jurídico, o hasta de dimensiones bélicas, es indispensable que el Estado en su naturaleza de benefactor y garantista, este obligado a satisfacer las necesidades jurídicas de sus asociados, así como crear y brindar las herramientas idóneas para garantizar el derecho fundamental de acceso a la justicia. Por lo anterior, en el presente informe se analizara las garantías existentes en Colombia para procurar el derecho de acceso a la justicia y la atención efectiva de las necesidades jurídicas respecto a los Mecanismos Alternativos de Solución de Conflictos (MASC) en el Distrito de Cartagena de Indias. Esa premisa permitirá ir de lo general a lo particular, dilucidando así, las características del tema desde un plano global y local, el primero de ellos, por supuesto, tendrá un desarrollo mucho más extenso dado el amplio campo de estudio que ofrece el tema en el país" |
