Summary, etc. El juez no solo cumple un papel dentro de la estructura del Estado (que frecuentemente es minimizado, en los textos procesales, como de "director del proceso"), sino que principalmente, en lo esencial, debe transformar el texto jurídico por excelencia, como es la ley (la Constitución y los textos legales) en el principal fundamento de sus decisiones, en su importante labor de resolver, de manera forzosa y legítima, los conflictos de intereses que se dan entre actores sociales, incluyendo al propio Estado entre ellos y, de esta forma, autorizar en casos concretos el uso de la fuerza oficial, luego de dar la oportunidad a todos los interesados de exponer hechos, presentar pruebas para comprobarlos y expresar sus criterios jurídicos, de tal forma que la justicia, entendida como decisión definitiva, razonablemente previsible e imparcial, sea siempre el producto de una controversia argumentativa en términos de igualdad.
