Summary, etc. El concepto de lo antijurídico ha de entenderse en función de autor y sólo interesa este aspecto subjetivo. Sólo puede haber "ilicitudes culpables", las acciones inculpables no pueden ser contrarias a la norma. No es posible hacer el juicio de antijuridicidad de un hecho humano, si no se observa la voluntariedad de este. La antijuridicidad cumple como función dogmática la determinación o especificación de los comportamientos que el ordenamiento jurídico considera como lesivos de los bienes jurídicos trascendentes penalmente; dicho en otras palabras, la antijuridicidad proporciona la razón de la tipificación de una conducta. La antijuridicidad es un elemento formal del delito, ya que se concreta en la oposición entre la norma y el hecho, y se manifiesta en la vulneración de una norma establecida por el Estado y perteneciente al ordenamiento jurídico.
