Summary, etc. El presente libro sostiene la necesidad de diferenciación jurídico-penal del cohecho y la concusión. No existe consenso en las legislaciones iberoamericanas sobre si la conducta del servidor público que constriñe, induce o solicita una dádiva, dinero o cualquier otra utilidad, debe adecuarse normativamente como modalidad del cohecho, o si, por el contrario, debe tipificarse autónomamente como delito de concusión. En esta obra se realizan los análisis normativo y dogmático de estas conductas. En la práctica los operadores judiciales con frecuencia califican como cohecho conductas que objetiva y subjetivamente deben tipificarse como concusión, y condenan equivocadamente por cohecho activo conductas en las que el particular, o incluso otros servidores públicos, obran coaccionados, siendo víctimas de concusión y no sujetos activos de cohecho activo. Los delitos de cohecho y concusión tienen unos ingredientes normativos específicos que los diferencian entre sí, y existe una justificación político-criminal para tipificarlos de manera separada. Concretamente, frente a la protección del bien jurídico de la administración pública, resulta legítima y garantista la tipificación autónoma de la concusión. Así lo contempla la legislación penal colombiana, como se detallará en esta obra.-- contracubierta
